These Terms & Conditions (“Terms”) govern your access to and use of Ballwhizz, including its mobile applications, website, games, digital content, virtual items, competitions, promotions and related services (collectively, the “Service”).
By using Ballwhizz, you agree to these Terms.
1. Acceptance of the Terms
By accessing, registering for, or using Ballwhizz, you agree to be bound by these Terms and any additional rules that may apply to specific games, competitions, promotions or features.
If you do not agree to these Terms, you should not use Ballwhizz.
2. Eligibility and Accounts
You are responsible for providing accurate information where required and for maintaining the security of your account and devices.
You may not access another person's account without permission, create or use accounts for fraudulent or abusive purposes, impersonate another person, or attempt to gain unauthorized access to Ballwhizz or its systems.
Ballwhizz may apply additional eligibility requirements to particular competitions, promotions, prizes or features.
3. Football Information and Third-Party Data
Fixtures, scores, statistics, player information, lineups, ratings, standings, news and other football information may be obtained from third-party data providers.
We aim to provide accurate and timely information, but Ballwhizz does not guarantee that football data will always be complete, accurate, error-free, uninterrupted or immediately updated.
Where game scoring or rewards depend on third-party football data, Ballwhizz may correct or recalculate results, Points, XP, rankings or rewards if the underlying data is corrected, updated or found to be inaccurate.
4. Predictions, Trivia, Cardz and Other Games
Ballwhizz provides Predictions, Trivia, Cardz and other interactive experiences for entertainment, competition and fan engagement.
Each game may have its own rules, entry costs, scoring methods, deadlines, eligibility requirements and reward structures.
Game rules and availability may vary by competition, matchday, season, country or campaign and may be updated when required to maintain fairness, improve gameplay or rebalance the Ballwhizz economy.
Submitting an entry does not guarantee that you will earn Points, XP, Boxes, Cards, Coins, Gems, prizes or any other reward.
5. Points, XP, Levels and Leaderboards
Ballwhizz may award Points and XP based on gameplay, performance or other eligible activities.
Points may be used for rankings and competitions and may reset according to the applicable season, competition or game rules.
XP represents lifetime progression unless otherwise stated and may be used to determine a user's Level or unlock progression-related features.
Leaderboard positions may change as results are processed, football data is updated, scoring corrections are made, or ineligible activity is removed.
Ballwhizz may correct Points, XP, Levels or leaderboard positions where an error, duplicate reward, technical issue, data correction, manipulation or abuse is identified.
6. Coins, Gems, Tokens and Virtual Items
Ballwhizz may provide virtual currencies and digital items including Coins, Gems, Tokens, Cards, Boxes, Boosts or other virtual items.
Unless expressly stated otherwise:
• Virtual items have no cash value and are not legal tender.
• Virtual items cannot be transferred, sold or exchanged outside mechanisms specifically provided by Ballwhizz.
• Virtual items do not represent ownership of money, securities or real-world assets.
• Virtual items may be earned, purchased, spent, exchanged or awarded according to the applicable Ballwhizz rules.
• Availability, pricing, utility and exchange requirements for virtual items may change as the Service evolves.
Ballwhizz may correct balances resulting from technical errors, duplicate grants, fraudulent activity, unauthorized transactions or exploitation of bugs.
7. Cards, Boxes and Random Rewards
Cards and Boxes are digital items used within Ballwhizz.
Boxes may contain randomized rewards. The type, quantity, rarity or value of items received may vary according to the applicable Box configuration and probabilities.
Receiving a particular Card or reward is not guaranteed unless Ballwhizz expressly identifies that reward as guaranteed.
Duplicate Cards may be permitted and may be used, exchanged, sold back or otherwise managed according to the features available within Ballwhizz.
Cards are associated with Ballwhizz competitions and seasons according to the applicable game rules and do not represent ownership of, endorsement by, or any commercial right relating to the real-world player, club or competition shown on the Card.
8. Seasons and Resets
Certain Ballwhizz game elements operate on a seasonal basis.
At the beginning or end of a season, Ballwhizz may reset seasonal Points, Cards, collections, rankings, game progress or other season-specific elements.
Unless otherwise stated in the applicable rules, Coins and Gems may carry between seasons, and XP may remain part of the user's lifetime progression.
Ballwhizz will determine which game elements reset or carry forward according to the rules applicable to each season.
9. Purchases and Paid Features
Certain virtual items, features or additional game attempts may be available through in-app purchases or other authorized payment methods.
This may include Coins, Gems, Boxes, additional attempts, paid edits, Insights or other optional features.
Prices may vary by platform, country, currency, taxes or applicable store policies.
Payments processed through Apple, Google or another payment provider are also subject to that provider's terms and payment policies.
Purchasing a virtual item or paid feature does not guarantee sporting results, game success, leaderboard position or eligibility for a prize.
10. Refunds and Purchase Issues
Refunds for purchases processed through third-party app stores or payment providers may be subject to their respective refund policies and procedures.
If you experience a missing purchase, incorrect balance or other payment-related issue, contact Ballwhizz Support and provide sufficient information for the transaction to be investigated.
Ballwhizz may restore or correct eligible digital items where a verified technical or transaction error has occurred.
11. Promotions, Competitions and Prizes
Ballwhizz may offer promotions, competitions, draws, leaderboards, tournaments or prize campaigns.
Each campaign may have additional rules governing eligibility, participation, deadlines, geographic restrictions, winner selection, verification and prize delivery.
Users may be required to provide information reasonably necessary to verify eligibility or deliver a prize.
Where permitted by law, Ballwhizz may disqualify users who manipulate results, exploit bugs, use multiple accounts improperly, provide false information or otherwise violate the applicable rules.
Prizes may be changed, substituted, delayed, suspended or cancelled where reasonably necessary due to legal, regulatory, operational or circumstances outside Ballwhizz's reasonable control, subject to applicable law.
12. Fair Play and Acceptable Use
You must not:
• manipulate or attempt to manipulate game results, rankings or rewards;
• exploit bugs, vulnerabilities or unintended game behaviour;
• use bots, scripts, automation or other unauthorized methods to interact with Ballwhizz;
• improperly operate multiple accounts to gain rewards or competitive advantages;
• interfere with Ballwhizz systems or other users' access;
• attempt unauthorized access to accounts, systems or data;
• submit fraudulent payment, prize or account information;
• impersonate another person;
• abuse, threaten or harass other users;
• upload or distribute unlawful or infringing material;
• use Ballwhizz in a manner that violates applicable law.
Ballwhizz may remove improperly obtained Points, XP, Coins, Gems, Cards, Boxes, rewards or leaderboard positions where abuse or manipulation is identified.
13. Community Features
Where Ballwhizz provides comments, polls, ratings, profiles, leagues or other community features, users are responsible for the content they submit.
Community activity must comply with the Ballwhizz Community Guidelines.
Ballwhizz may moderate, restrict or remove content or access where necessary to protect users, enforce these Terms or comply with applicable law.
14. Intellectual Property
Ballwhizz software, design, branding, interfaces, original content, game concepts and other intellectual property are owned by or licensed to Ballwhizz and are protected by applicable intellectual property laws.
Football club names, player names, competition names, logos, photographs, trademarks, statistics and other third-party materials remain the property of their respective owners or licensors where applicable.
Use of third-party names or information within Ballwhizz does not imply endorsement, sponsorship or affiliation unless expressly stated.
15. Service Availability and Changes
Ballwhizz is continuously evolving.
We may add, modify, rebalance, suspend or discontinue games, features, reward structures, virtual-item values, scoring systems, availability or content where reasonably necessary.
We may also perform maintenance or updates that temporarily affect availability.
Where appropriate, material changes may be communicated through the Service or other official Ballwhizz channels.
16. Suspension and Termination
Ballwhizz may restrict, suspend or terminate access where we reasonably believe that a user has:
• violated these Terms or applicable game rules;
• engaged in fraud, cheating, manipulation or abuse;
• compromised the security or integrity of the Service;
• infringed the rights of Ballwhizz, another user or a third party; or
• engaged in conduct that may cause harm to Ballwhizz or its users.
Where appropriate, Ballwhizz may also remove or correct rewards, virtual items, Points, XP or rankings associated with prohibited activity.
17. Limitation of Liability
To the extent permitted by applicable law, Ballwhizz is not responsible for indirect, incidental, special or consequential losses resulting from use of or inability to use the Service, interruptions, third-party services, third-party football data or reliance on information made available through Ballwhizz.
Nothing in these Terms excludes or limits rights or liabilities that cannot legally be excluded or limited under applicable law.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes to Ballwhizz, applicable laws, regulatory requirements or our services.
The updated version will be made available through Ballwhizz with an updated “Last Updated” date.
Where required by applicable law, we will provide additional notice or obtain consent for material changes.
